For selling Air Time on Mashal Radio Oldham 2010 

“Customer”      means The Company or its associated companies

In no event will Mashal Radio Oldham or its network services suppliers be liable for any damages, including but not limited to loss of data, loss of revenue or profits, or for any other special, indirect or consequential damages, arising out of or in connection with the use of or inability to collect the information hereunder. 

The customer agrees with Mashal Radio Oldham to pay all charges and any outstanding balance in FULL.  

Mashal Radio Oldham warrants to the customers that it will provide all services ordered with reasonable care and skill but Mashal Radio Oldham does not warrant or undertake this will cause the services to operate without fault or interruption. 

Mashal Radio Oldham shall use all reasonable endeavours to correct as soon as is reasonably practicable any fault notified by the customer. 

The customer warrants and undertakes that it shall in its use of the services comply with Mashal Radio Oldham acceptable usage policy, any relevant legislative and regulatory provisions and shall not use the services for any illegal purposes and shall indemnify Mashal Radio Oldham in respect of any liability incurred as a result of breached in this clause. 

Mashal Radio Oldham can never guarantee a product or services provided by a third party for and on behalf of a customer however, will endeavour to act in the best interest of the customer. 

Mashal Radio Oldham and its supplies disclaim all express and implied warranties including warranties of merchantability and fitness for a particular purpose, neither Mashal Radio Oldham nor its Network Service Suppliers will be liable for unauthorized access to or alterations, theft or destruction of end user’s data, programs procedures or information through accident, fraudulent means or devices, or any other method, regardless or whether such damage occurs as a result of Mashal Radio Oldham. 

The customer shall indemnify Mashal Radio Oldham and shall hold Mashal Radio Oldham harmless against any and all issues, damages, cost and expenses arising from or in connection with any claims or proceeding brought by third parties against RRO in respect of or arising directly or indirectly from the resale of services. 

Any notice required or unauthorised to be given may be delivered by post to the address stated for that arty and shall be deemed to have been served 72 hours after posting. 

Any individual about whom Mashal Radio Oldham processes personal data (as defined by the Data Protection Act). Mashal Radio Oldham may use such data to provide the customer with details of other Mashal Radio Oldham products/services which may be of interest to that individual.

In event of a dispute between the parties concerning this agreement each of the parties shall in the first instance, bring the dispute at the earliest opportunity to the attention of a Director or similar officer.

 All contacts are given by and constructed in accordance with English Law and the parties irrevocably agree to the exclusive jurisdiction of the English courts.

Editorial Contract:

1. Mashal Radio Oldham reserves full control.

2. Sponsored details will be mentioned six times of duration of the each sponsored programme

3. Advertisers own advert will only be accepted on either CD or Mini CD ten days prior to the transmission.

4. Mashal Radio Oldham will provide the recording facilities for making of the adverts.

5. Advertiser is ultimately responsible for all the adverts for the transmission.

6. Mashal Radio Oldham reserves the right to refuse any advert that is not appropriate to the Radio Station overall programming and consent.

7. Any agreed slot(s) lost dues to technical fault will be compensated by given extra slot where ever possible.

8. For any live advert, the script must be submitted ten days in advance of the transmission date.

9. Full invoice will only be issued upon receipt of full payment for the advertisements.
